Default Tucker, Fishman wish Chief S. to back down

On the agenda for the council meeting of Jan 26:

COUNCILMEMBERS TUCKER AND FISHMAN REQUEST THAT THE CITY COUNCIL CONSIDER DIRECTING THE CITY MANAGER TO WITHDRAW A FEBRUARY 11, 2008 LETTER TO THE STATE ALCOHOLIC BEVERAGE COMMISSION (ABC) IN WHICH POLICE CHIEF SAVELLI RECOMMENDED THAT UPON TRANSFER OF THE ALCOHOL LICENSE, THE OPERATOR BE REQUIRED TO CLOSE THE RESTAURANT OPERATION LOCATED AT 39 PIER AVENUE (IL BOCCACCIO) AT 12:00 MIDNIGHT. Memorandum from City Manager Stephen Burrell dated January 21, 2010

RECOMMENDATION: That the City Council review the subject request and provide any direction to staff on the request.

Default Good for Tucker and Fishman

The police chief should not be pressuring Hermosa businesses hours of operation. We do not live in an open police state yet I thought. However this looks to be the writing on the wall. Just because some residents go to bed at 12pm does not mean all go to bed at that time. I would pray that the police chief will protect and serve only, and not dictate to the city when establishments open and close.

My hat is off to Tucker and Fishman for realizing you do not want your police chief managing Hermosa businesses hours of operation.

The timing of this move is because, the following day, the chief is to testify at an ABC hearing on Newman's license.

My letter to Fish (cc'd to the council and the chief):

As you may know, I was an advocate of the recent decision to allow any and all restaurants to serve beer/wine before midnight. I have always held that alcohol service in establishments that close by midnight are not a burden on the community. I truly would not care if every store downtown was allowed to serve booze until midnight, and I'm sure that Chief Savelli would not disagree that these sorts of establishments are not a problem for the community.

However, the last thing our city needs is another bar that serves full liquor past midnight.

So, I am asking in all sincerity why you oppose the chief's recommendation to the ABC? If you are worried about the economy and think that only booze-serving establishments stand a chance of survival, then please ask the chief how much these types of establishments cost the city to police downtown after midnight. I have always maintained that booze past midnight is a lose-lose sitch for the city. That said, I think it's good that Hermosa has a few bars. We have several great ones, but enough is enough.

The Shore was reviewed why? Because of 50-50 violations.
Same with Dragon, 50-50 violations. What part of their CUP has Il Bocaccio been found in violation of? NONE.

The license is being transferred, so it's the new owners who are under scrutiny, not the Il Boccaccio owners.
